Terms of Use

These Terms of Use ("Terms") are an agreement between you and ThankAI ("we," "us," "our") for AirAudio for Windows (the "App"). They include the license under which the App is provided. By installing or using the App you agree to these Terms; if you do not agree, do not install or use it.

01License to use the App

The App is proprietary software. It is licensed to you, not sold. Subject to these Terms, we grant you a free, personal, non-exclusive, non-transferable, revocable license to install and use the App on Windows computers that you own or are authorized to use.

02Restrictions

Except as these Terms expressly allow, or as applicable law grants a right that cannot be waived, you may not:

• copy the App, other than installing it and making a reasonable backup;
• modify, translate or create derivative works of the App;
• reverse engineer, decompile, disassemble or otherwise try to derive the App's source code, algorithms or protocols;
• distribute, publish, sell, rent, lend, sublicense or host the App or its installer — please link to thankai.net/download instead;
• remove or alter any copyright, trademark or other notices in the App; or
• use the App, or knowledge gained from it, to build a competing product.

03Open-source components

The App includes open-source components (such as the Java runtime, Kotlin and Compose libraries, and an Opus audio encoder) that are licensed to you under their own licenses, listed in the App under About → Open-source licenses and in the installation folder. Nothing in these Terms limits your rights under those licenses.

04Acceptable use

You agree to use the App only for lawful purposes. You will not:

• use the App with speakers, networks or accounts you do not own or are not authorized to use;
• use the App to infringe anyone's intellectual property, privacy or other rights;
• use the App to violate the terms of any third-party device or service you use it with; or
• circumvent any technological protection measure, or use the App to do so.

05Updates and changes

The App may check thankai.net for updates and tell you when a new version is available. We may change, suspend or discontinue the App, or any feature, at any time.

06Intellectual property

The App and all its original portions — including its software, design, text and graphics — are owned by us or our licensors and protected by copyright and other laws. Third-party trademarks remain the property of their owners and are used only to describe compatibility (see the Disclaimer).

07No warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL WORK WITH ANY PARTICULAR SPEAKER OR NETWORK, OR THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE.

08Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM (USD $0 IF YOU RECEIVED IT FREE OF CHARGE). WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING LOSS OF DATA OR DAMAGE TO EQUIPMENT.

Some jurisdictions do not allow certain warranty disclaimers or limits of liability. Nothing in these Terms limits rights or remedies that cannot legally be limited or excluded.

09Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your use of the App or your violation of these Terms, any law or any third-party right.

10Termination

Your license ends automatically if you breach these Terms, and we may end it at any time. When it ends you must stop using the App and uninstall it. Sections 2, 6, 7, 8, 9 and 12 survive termination.

11Changes to these Terms

We may revise these Terms. Continued use of the App after changes are posted on this page means you accept the revised Terms.

12Governing law

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Wisconsin.
